Welcome to Cold Culture Club. These Terms of Service set out the rules for using our website and buying our products. By accessing our site or placing an order, you agree to these Terms, our Privacy Policy, Returns and Exchanges Policy, and Shipping Policy.

1. Using our site

You must be at least 18 or have a parent or guardian’s permission to use the site and place orders. You agree not to misuse the site or attempt to interfere with its security, systems or content.

2. Your account

You are responsible for keeping your login details secure and for all activity on your account. Tell us straight away if you suspect unauthorised use.

3. Products and descriptions

We try to be accurate, though minor differences can occur due to lighting, screens and production runs. If we spot an error in a description, price or availability, we may correct it and, if it affects an order, we will contact you before dispatch.

4. Prices, taxes and payment

Prices are shown in GBP and include UK VAT where applicable. Delivery charges are shown at checkout. We accept the payment methods shown on the site. Your card or payment method is charged when you place your order. If payment fails or is reversed, we may cancel the order.

5. Orders and acceptance

Your order is an offer to buy. We accept when we send the dispatch confirmation. We may refuse or cancel an order if a product is unavailable, there is a pricing error, we suspect fraud, or you do not meet eligibility rules. If we cancel after payment, we will refund you in full.

6. Delivery

Delivery options, prices and timeframes are set out in our Shipping Policy. Delivery times are estimates from the carrier and exclude processing time, weekends and bank holidays. Risk in the goods passes to you on delivery. Title passes to you once we receive full payment.

7. Returns, exchanges and cancellations

Your rights and the process are set out in our Returns and Exchanges Policy. In short:

You can return eligible items within 30 days of delivery.
Items must be unworn, unused, not wet, clean and odour free, in original packaging with tags.
Because there is no hygiene seal, change-of-mind returns are accepted only where handling has not gone beyond what is necessary to check size and fit. If an item shows signs of use, water, outdoor wear or soiling, we may reduce the refund to reflect diminished value, or decline the return if not hygienic or resellable.
Faulty or misdescribed items are handled in line with the Consumer Rights Act 2015.

8. Faults and remedies

If a product is faulty, not as described or not fit for purpose, contact us with photos. We will offer a repair, replacement or refund in line with UK consumer law. This is separate from any manufacturer’s warranty.

9. Promotions, discount codes and gifts

Only one promotion or code can be used per order unless we state otherwise. Codes have published start and end dates and cannot be exchanged for cash. If you return items bought with a promotion, any refund is adjusted to reflect the promotion. Free gifts must be returned if your refund removes eligibility.

10. User content and reviews

If you post reviews, photos or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and share that content in connection with our store and marketing. Do not upload anything unlawful, harmful, misleading, infringing or that breaches privacy. We may moderate or remove content at our discretion.

11. Intellectual property

All content on the site, including text, images, logos and graphics, is owned by us or our licensors. You may not copy, reproduce or exploit it without permission other than for personal, non-commercial use.

12. Third-party tools and links

Our site may use Shopify and other third-party tools, and may link to other websites. We are not responsible for third-party sites or services. Use them at your own discretion and review their terms and privacy policies.

13. Acceptable use

You agree not to:

break any laws when using the site or buying products
upload or transmit viruses, malware or harmful code
try to access accounts or systems without permission
harvest data or scrape the site
use the site for commercial solicitation without consent

14. Limitation of liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory rights as a consumer.

Subject to the above, we are not liable for: loss that was not foreseeable, loss not caused by our breach, business losses, loss of profit, revenue, data, goodwill or opportunity, or any indirect or consequential loss. If we are liable to you, our total liability will be limited to the amount you paid for the product giving rise to the claim.

15. Events outside our control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, such as strikes, carrier issues, extreme weather or supply problems. We will do our best to keep you updated and to find a fair solution.

16. Complaints and dispute resolution

If you have a concern, email ColdCultureClub@gmail.com and we will try to resolve it quickly. You can also seek advice from Citizens Advice. If you live in the UK or EU, you may use your local consumer dispute resolution body if available. These Terms do not affect your right to bring a claim in court.

17. Personal information

We handle your personal information as described in our Privacy Policy. By using the site, you consent to that processing.

18. Changes to these Terms

We may update these Terms from time to time. The version on this page is the one that applies. If we make significant changes, we will post a notice on the site. Your continued use of the site after changes means you accept the new Terms.

19. Severance

If any part of these Terms is found unlawful or unenforceable, the rest will remain in force.

20. Assignment

We may transfer our rights and obligations under these Terms to another organisation. This will not affect your rights. You may only transfer your rights with our written consent.

21. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Courts of England and Wales have non-exclusive jurisdiction, which means you may bring a claim in your local court if you live elsewhere in the UK.
